    An off-duty Toronto police office admits causing a life altering eye injury to a man — with his fists and not a weapon — but only because he feared for his safety.

    Michael Theriault, 27, took the stand in Oshawa Court Tuesday on aggravated assault and obstructing justice charges after Dafonte Miller was beaten and lost an eye in December 2016.

    His brother, Christian Theriault, 24, faces the same charges.

    The pair claims Miller was armed with a metal pipe and were attacked after he broke into their parents’ truck at their home.

    “I did cause an injury to Mr. Miller’s eye with my fists, but did so because Mr. Miller attacked me,” Theriault said.

    On the evening in question the brothers were having a smoke in their parents’ garage after a holiday gathering at around 2 a.m. when they heard sounds coming from the driveway.

    Theriault said his younger brother activated the garage door and rolled under it as it was raising to see two men at their parents truck, who promptly fled.
